1. The information relating to product or service gifts displayed on this Website is sourced from a variety of manufactures and suppliers and we display it in good faith. We make all reasonable efforts, at the time of display, to ensure that the information is accurate but due to the fact that at any time manufactures and suppliers can make model changes, specification changes, packaging changes, and service offering changes without prior notification, we are unable to warrant that the information on the Website will be totally accurate at all times and in respect to all products or services.

You acknowledge that information on the site that does not relate to actual product or service specifications is reproduced for general informational purposes only and that it is your responsibility to make decisions regarding the suitability of a product or service for the purpose you have in mind.

Limitation of Liability

1. yesChef.co.nz and its owners will not be liable to you for any loss or damage arising directly or indirectly in connection with the supply to you of goods or services from the Website except to the extent that such liability is not lawfully excluded under the applicable law.

2. yesChef.co.nz and its owners expressly exclude libaility for indirect, special, incidental or consequential loss or damage which may arise as a result of supplying goods or services to you in respect of other equipment or property, or for loss of profit, business, revenue, goodwill or anticipated savings.

3. In the event that any exclusion contained in these Terms and Conditions is held to be invalid for any reason and yesChef.co.nz becomes liable for loss or damage that may lawfully be limited, such liability shall be limited to the amount originally paid by you to aquire the goods or services, or the repair or replacement of the goods, or the reprovision of the service, at our discretion.

Prices:

1. The price for each product is shown beside each product on the site.

2. Prices are shown in New Zealand Dollars (NZ$) and exclude: GST (Goods and Services tax) at 12.5%, and exclude Freight.

3. You agree that prices shown on our website do not constitute an offer on our part and that we retain the right to correct any price that is incorrectly displayed at the time that we confirm your order. You agree that the order confirmation we send you is an invitation and it is your prerogative to accept or decline that invitation on its receipt.

Shopping and payment:

1. You may order products shown on yesChef.co.nz either on-line, or by telephone.

2. You may pay for your order by credit card (Visa and Mastercard only) or (by arrangement with us) by transfer of funds into our bank account, or by Cheque.

3. If you opt to pay for your order by credit card, you warrant that:

a) You are the owner of the card the details of which you have provided on the order and are legally entitled to use the card or, you have been authorized to use the card by the owner of the card for the purpose of shopping on yesChef.co.nz.

b) You are in possession of your card at the time of ordering.

c) You have sufficient funds on the card quoted in order to complete the purchase.

d) The order you are placing is a bona-fide order which you have every intention of completing.

4. If you order on-line, we will quickly send (to the email address supplied by you) an automatic email notice that we have received your order. This notice does not necessarily mean that your order is confirmed or approved.

5. As soon as your credit card, bank desposit or cheque has cleared we willl send an email order confirmation and proceed to fulfill your order.

6. If you cancel your order after receipt of order confirmation from us then we reserve the right at our sole discretion to deduct a re-stocking fee of NZ$ 25.00 per item from any credit we pass to your credit card and in the case of a bank deposit or cheque in addition any bank charges that we incur in passing funds back to you.

7. None of these provisions affect any relevant statutory rights you have under New Zealand consumer protection or sales of goods, law.

Purpose and location:

1. This site resides in New Zealand and primarily exists to provide New Zealanders with the items from timt to time shown on this website.

Applicable Law:

These terms and conditions and any dealings between you and yesChef.co.nz are governed by the law of New Zealand and any disputes will be decided exclusively by the courts of New Zealand.
